Workers Compensation Insurance in Oregon
Despite all the precautionary measures a company may have to prevent their employees from getting injured, Injuries in the workplace still happen and can cause serious harm, disability, and even death. Thankfully, the workers compensation system was developed to help workers get compensation through cash benefits, healthcare benefits, and disability insurance programs for work-related injuries and illnesses. With workers compensation, employers will assume most of the costs from work-related illnesses or injuries.
What Is Workers Compensation
Workers compensation insurance is a type of insurance that covers employees for injuries or illnesses that occur on the job. It’s required by law in most states and provides medical benefits and wage replacement benefits to injured workers.
What Happens When You Are Hurt On The Job
If you get hurt on the job, you may be eligible for workers’ compensation. The state of Oregon offers workers’ compensation benefits to employees who are injured during their work hours.
If you are injured at work, but not by another person or your own negligence, you may be able to obtain workers’ compensation benefits for medical expenses and lost wages.
What Happens If You Are Injured?
You can file an application with your employer, who will determine whether or not they will pay for your medical treatment and lost wages. If they decide not to pay, they may have an argument that you should have known it was dangerous to work in that position. They may also argue that there were no proper safety precautions in place at the time of the accident.
Document all injuries you have sustained while working, including any medical conditions that accompany these injuries, as well as any other work-related activities you may have been involved in prior to the accident or injury that resulted in your current condition (for example: walking down stairs; lifting heavy objects). This documentation will help determine if there were any circumstances leading up to this incident which could explain why you are claiming benefits.
What Are The Most Common Work-related Injuries?
The most common work-related injuries include:
- back injuries
- injuries to the hands and wrists (including carpal tunnel syndrome)
- fractures and dislocations of bones in the body. This includes sprains and strains, as well as broken bones.
In addition, workers compensation covers a variety of eye conditions caused by exposure to toxic substances during production processes at plants or factories. Eye damage may result from chemicals like formaldehyde or chlorine gas being released into the air while working with these materials on a daily basis. If you suffer from macular degeneration after being exposed to these types of chemicals over time then your employer can be held responsible for paying you compensation benefits under Oregon’s Workers’ Compensation Law!
What Are Your Rights for Workers’ Compensation?
Workers’ compensation insurance is a type of insurance that helps pay for medical expenses and lost wages after an accident on the job. If you are injured at work, it’s important to know your rights for workers’ compensation.
- You have the right to file a claim for your injury or illness in workers’ compensation court or the state industrial court.
- You have a right to a workers’ compensation hearing.
- You have the right to see a doctor and to pursue medical treatment for your work-related injuries.
The person who receives this type of coverage may be called a claimant (or “worker”) in Oregon; however, anyone can make a claim if they have been injured at work or contracted an occupational disease while working in Oregon. It’s important to understand how these benefits work so that you can make informed decisions about whether or not they’re right for your situation!

3 Step Process for Getting Workers Compensation
To get workers compensation, you will need to follow a 3-step process.
STEP1:
Inform your employer about any work-related injury as soon as possible. You should also be filling out form 801 or “Report of Job Injury or Illness’ which is provided by your employer, and hand it over to your employer. Your employer should then send it to their workers’ compensation insurance carrier within five days of your notice.
STEP2:
Let your doctor know of the work-related injury and submit medical records as soon as possible after being injured. Your doctor will help you complete form 827 or “Workers and Health Care Provider’s Report for Workers’ Compensation Claims.” Your doctor should then send this to the insurer within 72 hours of your visit. Note that your employer cannot pay out-of-pocket for your medical costs and you should not be billed by your doctor.
Step 3:
The only thing left to do now is wait. The insurer has about 60 days from the time when your employer was informed of the claim to accept or deny your insurance claim. You will then be notified of the decision in writing. In cases where your claim is denied, a letter will be sent to you by the insurer explaining why your claim was denied and what appeal rights you have.
